Bombay HC Orders DGFT to Release 38,500 MTs of Peas from Port After Penalty

Mumbai (Commodities Control) - The Bombay High Court has ordered for the release of 38,500 MTs of imported peas stuck at the port to be released after charging 10% penalty from some of the importers.
Pea importing firms - Harihar Collections and Raj Gro Impex LLP had appealed against the order of the Finance Ministry and other Government bodies, in this regard.


According to the High Court’s order dated 15th October, 11 Bills of Entry have been ordered to be released. Nearly 38,500 MTs of peas were imported as per these entry bills. The peas stuck at Mumbai port, will now have to be released.

Having said so, the High Court’s order is applicable on this particular import only. Meanwhile the Directorate General of Trade (DGFT) isn’t quite ready to back-off yet. It is believed that DGFT might challenge Bombay High Court’s order at the Supreme Court.

The details of this order were revealed on 20th October, Tuesday. Although, the market did not react in any way to this news. The High Court has rendederd, Centre’s order dated 2nd September 2020 ineffective. The court has ordered the associated Government bodies to clear all these Bills of Entry dated 18th November 2019 and 1st November 2019, respectively.
